Shalimar Country Club vs. Shalimar Association
The opening shot of the latest legal battle of the long war between the owners of the Shalimar golf course and members of the Shalimar Association was fired on June 20, 2010 (Father’s Day), when Nadine Campbell, President of the Shalimar Association, was served with a lawsuit at her home. Shalimar Country Club filed a quiet title action in Maricopa County Superior Court, claiming to be the owner of a tiny parcel of land, 2,000 sq. ft. in size, located at the intersection of River and Balboa in Tempe. This particular piece of property, known as Tract B Shalimar West Tax Parcel # 133-47-252, is a point of ingress and egress for the golf course.
Shalimar Country Club has been seeking to market the golf course property and Tract B has significance to potential developers. We believe if the golf course is sold to a developer Tract B may be seen as a possible egress/ ingress to the golf course thereby creating increased traffic, congestion, and disruption to the surrounding peaceful neighborhood. The property was acquired by the Association to prevent this from happening.
The Shalimar Association has fired back with a counterclaim to the quiet title lawsuit.
The Board of Directors of the Shalimar Association has retained Attorney Roger Decker of Udall, Shumway & Lyons, and they are confident of their ability to win this legal battle. The Association needs to raise significant funds to pay to pay for their defense. The estimated cost of this litigation is $15,000. The Board is asking the residents of the Shalimar neighborhood and other interested parties to contribute to their legal defense fund in order to fight this battle and help insure that Shalimar Golf Course remains a golf course. Simply put, we need 150 people to contribute $100 each, and we will meet our goal.
The Shalimar Association is a non-profit, civic organization and its purpose is to promote the best interests of the residents of the Shalimar Neighborhood. The neighborhood consists of the area bounded by Concorda Drive on the North, Country Club Way on the West, Southern Avenue on the South, and Price Road on the East. Membership in the Association is open to any person 18 years of age or older who lives in or owns any real property within the recognized boundaries of the Association. Other individuals, organizations, businesses, government agencies or nonprofit organizations may become Members if they have an interest in the goals and purpose of the neighborhood and are approved as Members by a majority vote at any general or special meeting.
